1. Acceptance of Terms

By using outbid.agency ("the Platform"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

2. Description of Service

outbid.agency is a pay-to-rank leaderboard platform. Users bid for placement on a public leaderboard. Higher bids rank higher. Listings remain active until outbid by a higher bid.

3. Bidding & Payments

  • Minimum bid: $2 USD (or equivalent in selected currency)
  • Bids must be whole numbers (no cents)
  • Payments processed via Dodo Payments; we do not store full card details
  • All bids are final — no refunds
  • If outbid, your listing moves down but remains on the board
  • You may bid again at any time to reclaim a higher position

4. Listing Requirements

  • URL must be valid and accessible
  • No adult content, illegal activities, malware, or phishing
  • No misleading, deceptive, or fraudulent descriptions
  • No content violating intellectual property rights
  • We reserve the right to reject or remove any listing at our discretion

5. Intellectual Property

You retain ownership of your submitted content (URL, name, description, logo). By submitting, you grant us a non-exclusive license to display it on the leaderboard.

The Platform's design, code, and branding are property of outbid.agency.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUTBID.AGENCY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability shall not exceed the amount you paid for your listing.

8. Indemnification

You agree to indemnify and hold harmless outbid.agency from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

9. Termination

We may suspend or terminate your access to the Platform at any time for violations of these Terms, with or without notice. Removed listings receive no refund.

10. Governing Law

These Terms shall be governed by the laws of the jurisdiction where outbid.agency operates, without regard to conflict of law principles.

11. Changes to Terms

We may modify these Terms at any time. Changes will be posted here with an updated date. Continued use after changes constitutes acceptance.
